1) Acceptance
By creating an account, purchasing a membership, or accessing the community at theofficialgcm.com, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2) Services & Eligibility
We provide an online community, courses, events, and digital content for creative professionals (the “Services”). You must be at least 18 and able to form a contract. You are responsible for your account security.
3) Membership Tiers & Access
We offer tiers including Emerging Visionary, Established Creator, GCM Ambassador, and Luminary Contributor (collectively, “Memberships”). Each tier grants access to specific spaces and benefits described on our site. We may modify features, provided changes do not materially reduce access during a paid term.
4) Billing, Renewals, Upgrades/Downgrades
Paid memberships bill via Stripe (processed through Memberstack). Plans renew automatically until canceled. Upgrades take effect immediately with a prorated charge; downgrades take effect at the next renewal. You authorize recurring charges to the payment method on file.
5) Cancellation & Refunds
You may cancel at any time in your account portal; access continues through the end of the current term. Except where required by law or stated otherwise on the checkout page, fees are non-refundable. We may suspend or terminate for non-payment or material breach.
6) Community Standards
You agree to follow our posted Community Standards/House Rules (respect, no harassment, no illegal content, proper crediting, and no spamming or scraping). We may remove content or restrict access to protect members and brand integrity.
7) Your Content & License
You retain ownership of content you post. You grant The Global Couture Mastermind LLC a non-exclusive, worldwide, royalty-free license to host, display, and share your content inside the community and, with your express opt-in for features/spotlights, to reproduce and distribute excerpts, images, and recordings for promotional purposes, with attribution as reasonably practicable. You represent you have rights to what you upload.
8) Event Recordings & Publicity Release
Live sessions may be recorded. By attending on-camera or speaking, you grant us permission to record, edit, and make the session available to members in the Replay Library. For use outside the community (public marketing), we will request your opt-in.
9) Intellectual Property
All site materials, brand marks, course content, and templates are owned by The Global Couture Mastermind LLC or licensors. Membership confers a personal, non-transferable license to view for your own use. No resale, redistribution, or training of competing services using our materials.
10) Third-Party Services
We integrate with platforms such as Circle, Memberstack, Stripe, Zoom, and YouTube. Their terms apply to your use of those services.
11) Disclaimers
Content is provided “as is” for educational purposes; no professional advice is being given. We do not guarantee specific outcomes, revenue, or results.
12) Limitation of Liability
To the maximum extent permitted by law, The Global Couture Mastermind LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for amounts exceeding the fees you paid in the 12 months before the claim arose.
13) Indemnification
You agree to indemnify and hold The Global Couture Mastermind LLC harmless from claims arising out of your content, your use of the Services in violation of these Terms, or any law or third-party rights.
14) Governing Law; Dispute Resolution
These Terms are governed by the laws of Ohio, without regard to conflict-of-law rules. Exclusive venue is Montgomery County, Ohio courts, or at our option, binding arbitration under AAA Commercial Rules seated in Ohio, with each party bearing its own fees absent a statutory right to fees.
15) Changes to Terms
We may update these Terms. Material changes will be announced in the community or by email. Continued use after the effective date constitutes acceptance.
16) Termination
We may suspend or terminate accounts that violate these Terms or the Community Standards. Upon termination, licenses you granted for in-community hosting survive for archival and compliance purposes.
17) Miscellaneous
These Terms plus the Privacy Policy are the entire agreement. If a clause is unenforceable, the rest remains in effect. You may not assign your rights without our consent.
